Про доцільність застосування терміна «заклад готельного господарства»

Abstract

У статті зроблено порівняльний аналіз нормативно-правових документів України щодо трактування термінів «готель» та «аналогічний засіб розміщення». Встановлено, що за українським законодавством саме ці типи засобів розміщення туристів повинні бути зареєстровані виключно як юридичні особи, що обмежує права фізичних осіб-підприємців на провадження готельної діяльності та звужує межі існуючої готельної бази. Виявлені певні протиріччя, які існують між нормативно-правовими актами України по засобах розміщення туристів. Запропоновано визначення поняття «заклад готельного господарства» як суб’єкта господарювання, котрий є готелем або аналогічним засобом розміщення та провадить діяльність із надання готельних послуг з обов’язковим обслуговуванням. Підтверджено доцільність застосування цього терміну на підставі проведення аналізу статистичних даних по закладах готельного господарства Одеського регіону.

The article analyzes the interpretation of the terms «hotel» and «similar accommodation establishment» according to the regulatory documents of Ukraine. It is established that under Ukrainian law, these types of accommodation establishments should be registered exclusively as legal entities, which limits the rights of sole entrepreneurs to conduct hotel business and narrows the boundaries of the existing hotel base. The contradictions that exist between the regulatory legal acts of Ukraine on the accommodation establishments are revealed. The purpose of the article is to determine the feasibility of introducing into the regulatory and scientific sphere the concept of «hotel industry establishment» instead of «enterprise» for such groups of collective accommodation establishments as «hotels» and «similar accommodation establishments». On the basis of comparative analysis of normative legal documents of Ukraine, it is necessary to identify problems with establishing the real capacity of accommodation establishments and conditions of hotel business taking into account the organizational and legal form of economic entities. Research of official statistics on the Odessa region will allow to make certain recommendations on optimization of structure of hotel establishments. The methodological basis of the article is the general scientific and special methods of investigation of: scientific abstractions, theoretical generalization and comparison – for specification of the conceptual framework, the analysis of the total number of the hotel type establishments; economic and statistical methods (grouping, tabular) – to conduct the analysis of the main aspects for development of tourism accommodation over a period of years. The authors propose to define the concept of «hotel industry establishment» as a business entity, which is a hotel or similar accommodation establishment and conducts business with mandatory hotel services. The expediency of using this term on the basis of the analysis of statistics on hotel industry establishments of the Odessa region was confirmed. It is pointed out the necessity of terminology optimization according to National Standard of Ukraine 4527:2006 «Touristic services. Tourism Accommodation. Terminology». It is recommended to harmonize the types of placement facilities for which statistical observations are made in the Form «Report on the Activity of Collective accommodation establishments», with the updated requirements of this National Standard.
