Питання гармонізації Українського конкурентного права із правом ЄС в контексті поглиблення євроінтеграції

Abstract

Мета статті полягає в дослідженні особливостей регулювання конкуренції в Україні, а також проблем гармонізації національного конкурентного законодавства із правом ЄС. Для досягнення мети застосовано статистичний аналіз динаміки припинених АМК України порушень у сфері недобросовісної конкуренції, зведених даних щодо антимонопольних справ та антимонопольних рішень Європейської Комісії. Узагальнено першочергові завдання з гармонізації українського конкурентного законодавства згідно з регламентами ЄС. Визначено, що потребує вдосконалення правова регламентація в сфері державних закупівель, захисту прав інтелектуальної власності, державної допомоги, передачі технологій, вертикальних угод, концентрації суб’єктів господарювання. Практична значимість полягає у подальшому розвитку досліджень з гармонізації українського конкурентного права із правом ЄС в контексті поглиблення євроінтеграції.

The purpose of the article is to study the peculiarities and problems of competition regulation in Ukraine, as well as to summarize the achievements in the harmonization of national competition legislation with EU law. To achieve the goal, a statistical analysis of the dynamics of the number of violations in the field of unfair competition stopped by the Antimonopoly Committee of Ukraine in terms of fines imposed and recommendations provided, statistical analysis of summary data on antimonopoly cases and antimonopoly decisions of the European Commission was applied. The schedule for harmonizing the competition legislation of Ukraine with the EU norms according to the Association Agreement between Ukraine, on the one hand, and the EU, the European Atomic Energy Community and their member states, on the other, has been systematized. The priority tasks of harmonizing Ukrainian competition legislation in accordance with EU rules and regulations are summarized. It was concluded that the principle of free competition is fundamental in the activity of the EU, and the competition policy has the character of uniform regulatory norms. It was emphasized that the adaptation of Ukrainian legislation to the EU legislation is one of the priorities of the modern policy of our state and is the process of bringing normative legal acts of Ukraine into compliance with the acquis communautaire. It was determined that there is a need to improve and ensure compliance of the current legislation of Ukraine with EU requirements, legal regulation in the field of public (state) procurement, protection of intellectual property rights, state aid, technology transfer, vertical agreements, concentration of economic entities. The practical significance lies in the further development of research on the issue of harmonization of Ukrainian competition law with EU law in the context of deepening European integration.
