Специфіка інтеграції норм господарського та ІТ-права у менеджменті промислових підприємств

Abstract

Мета дослідження полягає у визначенні специфіки інтеграції норм господарського та інформаційного права у процес управління промисловими підприємствами. Об’єктом дослідження є правові й економічні колізії, що виникають у процесі господарської діяльності суб’єктів підприємництва у сучасних умовах активної конкуренції. Предметом дослідження є відносини, що виникають при застосуванні норм господарського та ІТ-права у менеджменті промислових підприємств. У дослідженні було використано загальнонаукові і спеціальні методи дослідження: метод критичного аналізу, наукової абстракції та узагальнення наукового досвіду сучасних теоретичних досліджень, системно-комплексний підхід. У статті обґрунтовано необхідність ефективного застосування не лише традиційних норм господарського права, але й положень інформаційного права, що охоплює регулювання використання цифрових технологій, електронних транзакцій, захисту даних та кібербезпеки. Досліджено специфіку інтеграції норм господарського та інформаційного права у процес управління промисловими підприємствами. Визначено ключові напрями правового регулювання у сфері цифровізації бізнес-процесів, електронного документообігу, захисту комерційної таємниці та управління ризиками, з використанням інформаційних технологій. Акцентовано на практичних аспектах застосування законодавчих норм у сфері корпоративного управління, договірних відносин, кібербезпеки та трансформації правового середовища під впливом європейської інтеграції України. The purpose of the research is to determine the specifics of the integration of the norms of economic and information law into the process of managing industrial enterprises. The object of the study is legal and economic conflicts that arise in the process of economic activity of business entities in modern conditions of active competition. The subject of the study is the relations that arise when applying the norms of economic and IT law in the management of industrial enterprises. The study used general scientific and special research methods: the method of critical analysis, scientific abstraction and generalization of scientific experience of modern theoretical research, and a systemic and comprehensive approach. The article substantiates the need for effective application not only of traditional commercial law norms, but also of information law provisions, which cover the regulation of the use of digital technologies, electronic transactions, data protection and cybersecurity. It is determined that since the beginning of the war, too many enterprises and organizations have changed their locations and moved their business to other regions of Ukraine or abroad due to the fact that they had to face risks that were previously considered insignificant due to their low probability. It is stated that uncertainty in the activities of business entities has increased due to military risks, changes in the competitive environment and stakeholders, reprofiling, etc. It is noted that this significantly affects the security aspects of the activities of industrial enterprises, jeopardizing the processes of planning, management and control due to unpredictable changes in goals, deadlines, resources and budgets and requires adjustments to the regulatory and legal framework. It is emphasized that the main legislative basis for the business activities of industrial enterprises is commercial and IT law. The specifics of the integration of commercial and information law norms into the process of managing industrial enterprises have been studied. Key areas of legal regulation in the field of digitalization of business processes, electronic document management, protection of trade secrets and risk management using information technologies have been identified. Focus is on practical aspects of the application of legislative norms in the field of corporate governance, contractual relations, cybersecurity, and the transformation of the legal environment under the influence of Ukraine's European integration.
