Конкурентна політика: рекомендації ОЕСР та українські реалії

Abstract

Мета статті – на основі дослідження світового досвіду та ситуації у нашій країні визначити шляхи вдосконалення конкурентної політики в Україні. У процесі дослідження застосовано системно-структурний підхід, компаративний аналіз, синтез. Визначено причини та наслідки зниження інтенсивності конкуренції у розвинених країнах на початку ХХІ століття. Проаналізовано підходи ОЕСР до формування ефективної конкурентної політики, заходи, які ця організація пропонує здійснити урядам. Досліджено стан конкурентного середовища в Україні. Показано, що умовою динамічного розвитку вітчизняної економіки є виключення із законодавства антиконкурентних норм. Результати дослідження можуть бути використані для підвищення ефективності конкурентної політики в Україні за рахунок впровадження рекомендацій ОЕСР. The purpose of the article is to identify ways to improve competition policy in Ukraine based on a study of world experience and the situation in our country. The research process uses a systemic-structural approach, comparative analysis, and synthesis. The role of competition as a key factor in sustainable economic development and structural modernization of the economy is studied. The role of state policy in the formation of an effective competitive environment and the evolution of such policy in developed countries are analyzed. It is shown that the slowdown in labor productivity growth at the beginning of the 21st century is largely the result of a decrease in the intensity of competition. The OECD approaches to the formation of an effective competition environment are analyzed, as well as the measures that this organization proposes to governments. Special attention is paid to the Competition Assessment Toolkit, which provides a general methodology for identifying unnecessary restrictions on competition and developing alternative, less restrictive measures that ensure the achievement of the set goals. Another document prepared by OECD experts is also analyzed – the Competitive Neutrality Toolkit, which is aimed at creating equal conditions for competition between state and private enterprises, as well as between different private enterprises. The state of the competitive environment in Ukraine is investigated and it is found that many of its deformations are caused by state policy: the presence of significant administrative barriers, politically connected companies, unequal access to resources, and ineffective state aid. The implementation of the Law of Ukraine “On State Aid to Economic Entities” is studied, and the need to establish effective control over state aid is emphasized. It is shown that the exclusion of anti-competitive norms from legislation is a condition for the dynamic development of the domestic economy. The results of the study can be used to improve the effectiveness of competition policy in Ukraine by implementing OECD recommendations.
